What happened
The Landlord, a corporation, applied to the LTB to determine if the Residential Tenancies Act, 2006 (the 'Act') applies to an individual occupying their farm property. The individual was discovered living on the property and claimed he received permission from an acquaintance of one of the Landlord's directors. The Landlord maintained they never entered into any lease or agreement with the individual.
The ruling
It is ordered that the Residential Tenancies Act, 2006 does not apply. The Board found no tenancy agreement was ever formed between the Landlord and the occupant, as the individuals who gave the occupant permission to be on the property were not agents with authority to bind the Landlord. Therefore, the property is not a rental unit under the Act.
