What happened

The Landlord applied to evict the Tenant for non-payment of rent, with arrears exceeding $32,000. An interim order issued in February 2025 required the Tenant to pay ongoing rent, but the Tenant failed to comply, claiming confusion after a change in property management in November 2024. Due to the non-compliance with the interim order, the Board refused to consider the Tenant's maintenance issues. The Tenant had not made any rent payments since the application was filed.

The ruling

The tenancy is terminated unless the Tenant pays the Landlord $32,781.60 by June 30, 2025. If the payment is not made, the Tenant must move out by June 30, 2025, and owes the Landlord $30,541.33 plus daily compensation of $81.71 from June 4, 2025, until moving out. Relief from eviction was denied due to the substantial arrears, the Tenant's failure to comply with a previous LTB order, and the low probability of success for a repayment plan.
