What happened

The Landlord applied to terminate the tenancy and evict the Tenant alleging that the Tenant wilfully or negligently caused damage to the rental unit. Specifically, the Tenant knocked down the bathroom door and frame. The Tenant admitted to the damage but explained it occurred during a medical emergency when he urgently needed the washroom and found the door locked. The Landlord also alleged subsequent conduct issues, though no further damage had occurred since the initial incident.

The ruling

The LTB granted the Tenant relief from eviction. The tenancy continues on the condition that the Tenant does not wilfully or negligently cause damage to doors or frames for one year. The Tenant is ordered to pay the Landlord $186.00 for the application filing fee by August 26, 2025. If the Tenant breaches the condition, the Landlord may apply for an ex-parte eviction order within 30 days of the breach.
