What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to substantial interference with reasonable enjoyment. The Tenant lit a fire on the premises in contravention of municipal bylaws, which put the Landlord at risk of bylaw fines. The Tenant continued this conduct after being served a notice of termination.

The ruling

The tenancy is terminated, and the Tenant must vacate the rental unit by June 19, 2021. The Tenant must pay the Landlord $186 for the cost of filing the application. If the Tenant does not pay the full amount by June 19, 2021, they will owe interest at 2% annually on the outstanding balance starting June 20, 2021. If the unit is not vacated by June 19, 2021, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement.
