What happened

The Landlord, a corporation, applied to evict the Tenant to convert the residential unit into office space. The Tenant alleged the eviction was in bad faith and retaliation for a dispute over gas bills. The LTB found the Landlord acted in good faith, had taken necessary steps for the conversion, and granted the eviction, but postponed it to allow the Tenant time to move after receiving the required compensation cheque from the Landlord.

The ruling

The tenancy is terminated effective June 30, 2025, conditional on the Landlord providing a replacement compensation cheque of $1,390.00 by June 4, 2025. The Tenant is ordered to pay the Landlord $5,895.30 for use and occupation of the unit after the termination date on the notice, plus daily compensation until vacating. The eviction is postponed to June 30, 2025, to allow the Landlord to provide the cheque and the Tenant to find new accommodation.
