What happened

The landlord applied for an order to terminate the tenancy and evict the tenants due to their failure to pay rent as ordered in a previous LTB order. The tenants were required to pay $10,634.12 in rent arrears and application fees, but still owed $6,936.78 from the previous order. They also failed to pay the full rent for March and April 2023.

The ruling

The tenancy is terminated effective May 27, 2023. The tenants must pay the landlord $9,954.81, which includes rent arrears up to May 16, 2023, and $63.30 per day in compensation for use of the unit starting May 17, 2023 until they move out. The landlord is entitled to file the order with the Sheriff to enforce the eviction if the tenants do not vacate by May 27, 2023.
