What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Landlord served a valid N4 notice which the Tenant failed to void. Despite being properly served with the notice of hearing, the Tenant did not attend. The Landlord provided evidence that the Tenant remained in possession of the unit and had not made any payments since the application was filed.
The ruling
The tenancy is terminated unless the Tenant pays $9,596.19 by September 30, 2025, or $11,183.92 by October 4, 2025, to void the order. If the Tenant does not void the order, they must vacate the unit by October 4, 2025. The Tenant is ordered to pay $6,896.27 to the Landlord, which accounts for arrears up to the hearing date and the filing fee, less the rent deposit and interest. Daily compensation of $52.20 is also ordered until the unit is vacated.
