What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and additional charges related to NSF cheques. The Landlord also sought reimbursement for the application filing fee. The Tenant failed to appear at the hearing despite being properly served. The LTB found that the Landlord served a valid N4 notice and that substantial arrears remained despite a partial payment made by the Tenant after the application was filed.

The ruling

The tenancy is terminated effective August 17, 2025. The Tenant is ordered to pay the Landlord $2,471.31 if the tenancy is terminated. To void the eviction and continue the tenancy, the Tenant must pay $6,504.60 to the Landlord or the LTB in trust by August 17, 2025. This amount includes arrears, NSF charges, and filing fees, minus the recent payment. If terminated, the Tenant must also pay daily compensation of $65.75 until they vacate.
