What happened

The Landlord applied to terminate the tenancy for non-payment of rent and persistent late payment. During the proceedings, the Landlord withdrew the persistent late payment application. The Tenant, a long-term resident with disabilities on a fixed income, admitted to arrears but sought relief from eviction to avoid homelessness. The Landlord sought eviction, citing financial pressure from inconsistent payments. The LTB member granted a conditional order allowing the Tenant to stay provided she adheres to a monthly repayment plan for the arrears.

The ruling

The LTB dismissed the persistent late payment claim and granted the Tenant relief from eviction for rent arrears. The Tenant is ordered to pay $788.69 (arrears plus filing fee) according to a monthly schedule of $100 starting May 30, 2025, plus current rent on time. If any payment is missed, the Landlord can apply for an immediate eviction order without notice.
