What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Tenant entered into an agreement to terminate the tenancy. The Tenant filed a motion to set aside the order, claiming he did not sign the agreement.

The ruling

The Tenant's motion to set aside the eviction order was denied. The Board found that the Tenant did in fact sign the N11 agreement to terminate the tenancy, and that it would not be unfair to enforce the agreement. The stay of the eviction order was lifted immediately.
