What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Tenant entered into an agreement to terminate the tenancy.

The ruling

The tenancy between the Landlord and the Tenant is terminated. The Tenant must move out of the rental unit on or before May 31, 2021. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. However, the Tenant cannot be evicted due to Ontario Regulation 266/21 under the Emergency Management and Civil Protection Act, and eviction by the Sheriff may only occur after the regulation is removed by the Ontario Government.
