What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant did not pay the rent arrears to void the N4 notice before the hearing date.

The ruling

The Tenant is ordered to pay $11,986 to the Landlord, which includes rent arrears up to September 8, 2023 and the application filing costs, minus the rent deposit and interest. The Tenant is granted a 6-month repayment plan, with a lump sum payment of $6,000 due by September 22, 2023 and monthly payments of $1,000 from October 2023 to February 2024, with a final payment of $986 due by March 9, 2024. The Tenant must also pay the ongoing rent as it becomes due during the repayment period. If the Tenant fails to make any of the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
