What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. A valid N4 Notice was served, but the Tenant failed to pay the arrears to void the notice. Although the Tenant made a $1,000.00 payment after the application was filed, the arrears significantly increased by the hearing date. The Tenant failed to attend the hearing, and the adjudicator found no grounds to grant relief from eviction.
The ruling
The tenancy is terminated effective September 14, 2025, unless the Tenant voids the order by paying $4,186.00. If the Tenant does not pay, they must vacate the unit by September 14, 2025. If the tenancy is terminated, the Tenant is ordered to pay $2,383.26 to the Landlord, plus daily compensation of $32.88 for each day they remain in the unit starting August 26, 2025. Post-judgment interest will accrue at 4.00% annually starting September 15, 2025.
