What happened

The Landlord obtained an ex parte eviction order after alleging the Tenant breached a previous conditional order. The Tenant filed a motion to set aside the order, claiming no breach occurred and that he possessed a rent receipt. During the hearing, the Member intervened to ensure the self-represented Tenant understood his legal options, leading to an objection from the Landlord's representative. Following consultation with Duty Counsel, the parties reached a consent agreement to set aside the eviction and revert to the original order.

The ruling

The motion to set aside the order issued on September 9, 2025, is granted. The ex parte eviction order is set aside and cannot be enforced. The previous conditional order issued on July 10, 2025 (LTB-L-018058-25) remains in full force and effect.
