What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to pay rent as ordered in a previous LTB order. The landlord was entitled to apply for this order without notice to the tenant as the previous order specified the conditions under which the landlord could do so.

The ruling

The tenancy is terminated effective May 28, 2023. The tenant must pay the landlord $1,982.50 plus $32.38 per day for each day the tenant occupies the unit after May 17, 2023. If the tenant does not pay the full amount by May 28, 2023, the tenant will owe interest at 6% annually on the outstanding balance.
