What happened
Landlord applied to terminate the tenancy and evict the Tenants due to the Tenant, Melville Abraham, committing an illegal act by threatening another tenant with a machete, and the Tenants' aggressive behavior towards other tenants and the Landlord's staff, which substantially interfered with the Landlord's and other tenants' reasonable enjoyment and lawful rights and privileges.
The ruling
The tenancy is terminated effective October 4, 2021. The Tenants must move out of the rental unit on or before October 4, 2021. The Tenants shall pay the Landlord $1,925.61, which represents compensation for the use of the unit from July 27, 2021 to September 29, 2021, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenants shall also pay the Landlord $55.73 per day for compensation for the use of the unit from September 30, 2021 to the date they move out of the unit, as well as $186.00 for the cost of filing the application. If the Tenants do not pay the full amount owing by October 4, 2021, they will start to owe interest at 2.00% annually on the balance outstanding.
