What happened
The Landlord filed an application for eviction due to rent arrears. However, the Tenant proved that a payment agreement had been established via email on December 11, 2024, prior to the Landlord filing the application on December 17, 2024. The Tenant had also cleared all arrears by January 31, 2025. The Board found the Landlord's application unnecessary and dismissed it, denying the Landlord's request for reimbursement of the application fee.
The ruling
The Landlord's application is dismissed. The Tenant had paid the rent arrears in full, bringing the balance to zero. The Landlord was not awarded the application filing fee because the application was filed unnecessarily, as a payment plan was already in place with the Tenant.
