What happened

The Landlord applied to terminate the tenancy and evict the Tenants because they failed to pay the lawful rent. A valid N4 notice was served, and the Tenants did not pay the arrears or attend the hearing. The Board found the Tenants remained in possession of the unit and had not made any payments since the application was filed, leading to a substantial growth in arrears.

The ruling

The tenancy is terminated effective August 18, 2025. The Tenants are ordered to pay $4,343.12 to the Landlord, which accounts for rent arrears to the hearing date and the filing fee, minus the rent deposit and interest. To void the eviction and continue the tenancy, the Tenants must pay $7,186.00 by August 18, 2025. Daily compensation of $46.03 applies until the unit is vacated.
