What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Gilbert Bello Santana was still in possession of the rental unit at the time of the hearing.

The ruling

The tenancy is terminated unless the tenant pays $14,964.79 by May 14, 2023 or $16,514.79 by May 22, 2023 to void the order. If the tenant does not pay, the tenant must vacate the unit by May 22, 2023 and pay the landlord $12,457.49 plus daily compensation of $50.96 from April 27, 2023 until the tenant vacates.
