What happened
The Landlord applied to evict the Tenant for persistent late payment of rent. The uncontested evidence showed the Tenant paid rent late 11 out of 12 months and continued to do so after an N8 notice was served. The Tenant, who was absent from the hearing, had previously informed the Landlord via email that she would be vacating by May 31, 2025.
The ruling
The tenancy is terminated effective May 31, 2025, due to the Tenant's persistent late payment of rent. The Tenant must vacate the unit by this date. Additionally, the Tenant is ordered to pay the Landlord $186.00 for the application filing fee. The last month's rent deposit held by the Landlord will be applied to the unpaid May 2025 rent.
