What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant attempted to raise maintenance issues regarding lack of heat and a prior flood under section 82, but these were dismissed due to lack of required disclosure. The Tenant requested a long-term repayment plan, which the Board rejected as unreasonable given the Tenant's financial deficit and the length of time needed to clear the balance.

The ruling

The tenancy is terminated effective August 15, 2025, unless the Tenant voids the order by paying the full arrears plus filing fees (totaling $11,045.86 if paid by August 15). The Landlord is awarded $8,160.73 for arrears up to the hearing date plus daily compensation for continued occupation. Eviction was briefly postponed to August 15, 2025, to allow the Tenant time to find housing for his three children.
