What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective October 9, 2021. The Tenants must pay the Landlord $5,914.47, which includes rent arrears up to September 28, 2021 and the cost of filing the application, less the rent deposit and interest on the deposit. If the Tenants do not pay the full amount by October 9, 2021, they will start owing interest, and the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenants can void the eviction order by paying $7,436 by September 30, 2021 or $8,886 by October 9, 2021.
