What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The landlord served valid N4 and N8 notices, but the tenants did not void the notices by paying the arrears. The tenants were not present at the hearing.

The ruling

The tenancy is terminated effective May 21, 2023 unless the tenant pays $20,686 to void the order. If the tenant does not void the order, they must pay the landlord $16,698.57, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit. The tenant must also pay daily compensation of $65.75 for each day of occupation starting May 2, 2023 until they vacate the unit.
