What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord served an N8 notice on January 21, 2022, citing 11 instances of late payment in the previous 12 months. Despite some improvement in rent payment after the notice, late payments continued.

The ruling

The Landlord and Tenant Board issued a conditional order allowing the tenancy to continue if Tenants pay rent on time for 12 months from February 1, 2023, to January 31, 2024. Tenants must also pay the $186 application fee. If conditions are not met, the Landlord can apply for eviction within 30 days of a breach.
