What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears. The Tenant had not paid the full rent from February 1, 2020 to September 30, 2020.

The ruling

The tenancy is terminated effective October 16, 2020. The Tenant must pay the Landlord $1,223.03, which includes rent arrears up to October 5, 2020, less the rent deposit and interest on the deposit. The Tenant must also pay $44.78 per day for compensation for use of the unit starting October 6, 2020 until the Tenant moves out. If the Tenant does not pay the full amount by October 16, 2020, the Tenant will start to owe interest. If the unit is not vacated by October 16, 2020, the Landlord may file the order with the Court Enforcement Office for enforcement.
