What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant admitted to the arrears but explained they were caused by an interruption in social assistance payments from Ontario Works. The Tenant expressed confidence that the arrears would be settled soon and noted they live with two children. The Member found the Tenant's testimony credible and postponed the eviction date to balance the interests of both parties.
The ruling
The tenancy is terminated effective November 30, 2025, unless the Tenant voids the order by paying the specified arrears ($5,065.00 if by Oct 31, or $7,065.00 if by Nov 30). If the Tenant does not void the order and does not move out, the Landlord can enforce the eviction starting December 1, 2025. If the tenancy is terminated, the Tenant is ordered to pay $1,891.94 to the Landlord, which accounts for arrears to the hearing date and costs, minus the rent deposit and interest.
