What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant failed to meet a condition of a previous consent order (LTB-L-067799-24). Specifically, the Tenant was required to pay monthly rent on time but paid July 2025 rent on July 11 instead of July 1. The Tenant argued that the delay was caused by a fraud alert on their bank account and requested relief from eviction, noting the long-term nature of the tenancy and the unit's proximity to mental health resources for their son.
The ruling
The LTB confirmed the Tenant breached a previous order but granted relief from eviction. The previous order (LTB-L-067799-24) is cancelled and replaced. The tenancy continues on the condition that the Tenant pays the lawful monthly rent in full and on time from October 1, 2025, through September 1, 2026. If the Tenant fails to pay on time during this period, the Landlord may apply for an ex parte eviction order within 30 days of the breach.
