What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant disputed owing rent for October 2021, claiming excess payments in September 2021. Landlord argued that excess payments were applied to older arrears from July and August 2021.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying $17,436.00 by July 31, 2022. If not voided, the Tenant must vacate by July 31, 2022, and pay $15,006.78 plus $56.71 per day from July 8, 2022, until move-out. The Landlord may file for eviction enforcement starting August 1, 2022, if the unit is not vacated.
