What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective August 8, 2021. The Tenants shall pay the Landlord $3,725.06, which represents the rent owing to July 28, 2021 and the Landlord's filing fee, less the rent deposit and interest owing on the deposit. The Tenants shall also pay the Landlord $30.74 per day in compensation for the use of the unit from July 29, 2021 to the date they vacate. If the Tenants do not pay the full amount owing by August 8, 2021, they will owe simple interest calculated from August 9, 2021 at 2.00% annually on the balance outstanding. The order will be void, and the tenancy will not terminate, if the Tenants pay $4,781.70 on or before July 31, 2021 or $5,716.80 on or before August 8, 2021.
