What happened

The Landlord applied to terminate the tenancy to perform extensive renovations requiring vacant possession. The Tenant challenged the application on the grounds of bad faith and insufficient compensation. The Board found that the Landlord failed to prove the necessity of vacant possession and had underpaid the mandatory three-month compensation required under the Act. Furthermore, the Landlord failed to provide evidence for alleged water leaks and was found to be renting out other units at significantly higher market rates without performing the same renovations.

The ruling

The Landlord's application to terminate the tenancy for renovations is dismissed. The Board found the Landlord failed to provide the full mandatory compensation and did not demonstrate a good faith intent to perform the renovations as described. Because the application was dismissed and the Tenant remains in the unit, the Tenant is ordered to return the $2,006.87 compensation previously provided by the Landlord by July 4, 2025.
