What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice). The parties reached an agreement to terminate the tenancy as of December 31, 2020.

The ruling

The tenancy was terminated effective December 31, 2020 by agreement of the parties. The tenants are ordered to pay $7,560.38 to the landlord, which includes rent arrears up to the termination date and compensation for use of the unit, minus the rent deposit and interest on the deposit. The tenants must also pay $175 for the cost of filing the application. If the full amount is not paid by January 24, 2021, the tenants will owe interest at 2% annually on the outstanding balance.
