What happened
The Landlord applied for an order to terminate the tenancy after the Tenants breached a condition of a previous mediated order issued on June 11, 2025. An ex-parte eviction order was issued on July 30, 2025. Tenant 2 filed a motion to set aside this order, claiming she felt pressured into the mediation and citing financial hardship and childcare responsibilities. The Board examined whether the mediation agreement was entered into under duress and whether it would be unfair to proceed with eviction.
The ruling
The motion to set aside the eviction order is denied. The Board found that the Tenants breached the mediated payment plan and that the tenancy is no longer financially viable. The stay of the eviction order issued on July 30, 2025, is lifted effective October 31, 2025. The original terms of the ex-parte order remain unchanged.
