What happened

The Landlord applied for an ex parte eviction order after the Tenant breached a previous conditional payment order by missing a $405.00 arrears payment in April 2025. The Tenant filed a motion to set aside the resulting eviction order (LTB-L-037210-25), arguing that her financial circumstances had improved significantly with new employment and a housing benefit grant.

The ruling

The LTB granted the Tenant's motion to set aside the eviction order issued on May 20, 2025. The previous order was cancelled and replaced with a new conditional order requiring the Tenant to pay $3,581.00 in arrears through a monthly installment plan ending in May 2026. The Tenant must also pay ongoing monthly rent in full. Failure to meet any payment allows the Landlord to re-apply for eviction without further notice.
