What happened
The Landlord applied for an order to terminate the tenancy and collect rent arrears. The tenancy had already been terminated by a previous consent order effective April 30, 2024, and the Tenant no longer resides in the unit. The parties agreed on the amount of arrears owing up to the termination date, despite the Tenant paying a significant sum after the application was filed. The Tenant attempted to raise maintenance issues under section 82, but the Member declined to hear them due to the Tenant's failure to comply with disclosure requirements set in a previous interim order.
The ruling
The Tenant is ordered to pay the Landlord $7,208.44, representing rent arrears up to the April 30, 2025 termination date and the application filing fee. The Member refused to hear the Tenant's maintenance claims because the Tenant failed to provide the Landlord with the required disclosure of issues and details as previously ordered.
