What happened

Landlords applied to terminate the tenancy and evict Tenants due to non-payment of rent and persistent late payment of rent. The Landlords served valid N4 and N8 notices, but the Tenants did not void the notices by paying the arrears. The Tenants had vacated the rental unit prior to the hearing date.

The ruling

The tenancy was terminated effective August 31, 2021, but the Tenants were ordered to vacate the unit by November 5, 2021. The Tenants were ordered to pay $3,217.29 in rent arrears and compensation, plus $42.58 per day starting September 1, 2021 until they vacate the unit. If the Tenants do not pay the full amount by November 5, 2021, they will owe interest at 2% annually on the outstanding balance.
