What happened
Tenant applied for an order determining that Landlord entered the rental unit illegally, altered the locking system without providing replacement keys, and substantially interfered with the Tenant's reasonable enjoyment of the rental unit. The Tenant also applied for an order determining that the Landlord failed to meet maintenance obligations.
The ruling
The Tenant's request for review was granted. The Landlord's actions in illegally locking out the Tenant and subsequently demolishing the rental unit and disposing of the Tenant's possessions were found to be a blatant disregard for the Residential Tenancies Act. The Landlords were ordered to pay the Tenant for the loss of his possessions, rent differential, general damages, and an administrative fine.
