What happened
The Co-op applied to terminate the Co-op Members' occupancy and evict them due to failure to pay regular monthly housing charges and persistent late payment of those charges. The Co-op Members refused to pay any charges until their housing subsidy was reinstated, which the LTB has no jurisdiction to do.
The ruling
The Co-op membership is terminated effective March 31, 2015. The Co-op Members must vacate the unit by that date. They are ordered to pay the Co-op $16,378, which represents the amount of regular monthly housing charges owing and compensation up to March 31, 2015, less the refundable deposit plus the application filing fee. If they do not pay by March 31, 2015, they will owe interest starting April 1, 2015.
