What happened

Tenant applied for an order determining that Landlord failed to meet maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The issue was a broken pipe in the basement that was leaking sewage and causing a foul odor.

The ruling

The Landlord failed to meet their maintenance obligations under the Residential Tenancies Act, 2006. The Tenant is awarded a rent abatement of $2,700 and the Landlord is ordered to dig up and replace the broken pipe by December 31, 2016. If the Landlord does not complete the work, the Tenant is authorized to arrange the replacement and deduct the cost from future rent payments.
