What happened

Tenant applied for an order determining that the Landlord withheld or deliberately interfered with the reasonable supply of a vital service, care service, or food that the Landlords are obligated to supply under the tenancy agreement. The Tenant wanted to terminate the tenancy early due to pest issues, but the Landlord refused.

The ruling

The Tenant's application was dismissed due to being filed after the one-year limitation period had expired. The Tenant was aware of the problem and sought to terminate the tenancy as early as December 2014, but filed the application on February 29, 2016.
