What happened
Tenant filed an application alleging that the Landlord failed to meet its maintenance obligations under the Residential Tenancies Act, 2006, including issues with inadequate insulation, damaged flooring, broken kitchen cabinets and drawers, and cracked common area walls.
The ruling
The Landlord is ordered to pay the Tenant a rent abatement of $7,520, reimburse the Tenant $574.03 for out-of-pocket expenses, and complete various repairs to the rental unit by January 26, 2017. If the Landlord does not complete the repairs, the Tenant is authorized to arrange for the work to be done and deduct the cost from the rent. The Landlord must pay the Tenant the full amount owing by January 2, 2017, or will owe interest.
