What happened

Tenant applied for an order determining that the Landlord unlawfully retained the Tenant's last month's rent deposit. The parties reached an agreement the day before the hearing, but the Tenant was unsure about the payment date. The Landlord attempted to have the Tenant waive his rights under the Residential Tenancies Act, which the Board found unenforceable.

The ruling

The Landlord shall pay the Tenant $549.62 for the unused portion of the last month's rent deposit and accrued interest by November 20, 2021. If the Landlord does not pay by that date, they will owe simple interest at 2% annually on the outstanding balance.
