What happened

Landlord applied to terminate the tenancy and evict Tenants due to undue damage to the rental unit, including a shattered kitchen stove/oven top and a broken door stopper. The Landlord served a valid N5 notice, but the Tenants did not void it within the 7-day period by repairing the damage or paying the costs.

The ruling

The Tenant is ordered to pay the Landlord $909.49 for the cost of repairing the damage and $186 for the application filing fee, with the total amount due by November 20, 2021. If the Tenant does not pay the full amount by the due date, the tenancy will be terminated on November 30, 2021, and the Landlord may file the order with the Court Enforcement Office to enforce the eviction.
