What happened

Landlord applied for termination of tenancy and eviction due to non-payment of rent and persistent late payment. The initial order was issued in Landlord's favor. Tenant requested a review, claiming inability to receive hearing notices due to a full mailbox and unmonitored email. The review request was denied.

The ruling

The Landlord and Tenant Board denied the Tenant's request to review the original order (LTB-L-031373-22) issued on September 27, 2022. The Board determined that the Tenant was reasonably able to participate in the August 8, 2022 hearing and did not demonstrate due diligence in monitoring communications. The original order remains unchanged.
