What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective October 26, 2020. The Tenants must pay the Landlord $2,069.25, which includes rent arrears up to October 15, 2020 less the rent deposit and interest, plus $175 application fee and $38.20 per day in compensation starting October 16, 2020 until they move out. If the Tenants pay $3,988.34 on or before October 26, 2020, the eviction order will be void and the tenancy will continue.
