What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant admitted to not having enough income to pay the monthly rent or any of the arrears owing.

The ruling

The tenancy is terminated unless the Tenant voids the order by paying $20,934.00 by November 30, 2022. If not voided, the Tenant must move out by November 30, 2022, and pay the Landlord $18,399.62 plus $49.91 per day from November 11, 2022, until vacating. The Landlord may file for eviction enforcement starting December 1, 2022, if the unit is not vacated.
