What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant had not paid the full rent owed from December 1, 2016 to September 30, 2020, and the Landlord had served a valid Notice of Termination. The Tenant was in possession of the rental unit on the hearing date but did not attend.
The ruling
The tenancy is terminated effective June 19, 2021. The Tenant must pay the Landlord $25,334.98 (less any payments made after September 16, 2020), plus $41.10 per day starting June 9, 2021 until the Tenant vacates. If the Tenant pays $27,673 (less any payments made after September 16, 2020) by June 19, 2021, the eviction order will be void and the tenancy will continue.
