What happened

Landlord applied for termination of tenancy and eviction due to non-payment of rent. Tenant raised maintenance issues and requested rent abatement. The Board found the Landlord in breach of maintenance obligations but not seriously enough to dismiss the eviction application. The tenancy was terminated with a delayed eviction date.

The ruling

The Board terminated the tenancy effective April 30, 2022, but allowed the Tenant to void the eviction by paying the arrears. The Tenant was granted a rent abatement of $5,180 for maintenance issues. The Tenant must pay $4,643.41 plus $42.08 per day from February 1, 2022, until move-out, and the $186 application fee.
