What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and for the Landlord's personal use of the rental unit. The Landlord also applied for an order requiring the Tenants to compensate the Landlord for the Tenants' failure to pay utility costs.

The ruling

The Landlord's L2 application based on the N12 notice was dismissed as the notice was found to be defective. However, the Landlord was granted an order for the rent arrears of $20,500 and utility costs of $1,103.83 owed by the Tenants, for a total of $21,789.83. If the Tenants do not pay the full amount by June 11, 2023, they will start owing interest at 6% annually on the outstanding balance.
