What happened
Landlords applied to terminate the tenancy and evict Tenants due to non-payment of rent. Landlords also claimed NSF cheque charges and related administration charges.
The ruling
The request to review order TEL-11481-20 issued on January 4, 2021 is granted. The order is cancelled. The tenancy is terminated as of October 20, 2020, the date NA gave vacant possession of the rental unit to the Landlord. NA shall pay to the Landlords $18,822.81 which represents the amount of rent owing and compensation up to October 20, 2020 and the total charges related to NSF cheques tendered to the Landlords, less the rent deposit and interest the Landlords owe on the rent deposit. NA shall also pay to the Landlords $190.00 for the cost of filing the application. If NA does not pay the Landlords the full amount owing on or before April 17, 2021, NA will start to owe interest.
