What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's wilful damage to the rental unit. The Landlord alleged three separate incidents of damage, but the Landlord's evidence was only sufficient to establish one incident on January 29, 2021 where the Tenant had ripped apart a wall without the Landlord's consent.
The ruling
The tenancy is terminated effective September 26, 2021. The Tenant must vacate the rental unit by that date. The Tenant must pay the Landlord $201 for the application filing fee. If the Tenant does not pay the amount owing by September 26, 2021, the Tenant will owe interest at 2% annually on the outstanding balance starting September 27, 2021. If the unit is not vacated by September 26, 2021, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction.
